New changes to the law no. 9947, dated 07.07.2008 “On Industrial Property” Upon proposal of the Council of Ministers, the Parliament approved Law No. 96/2021 “On amendments and additions of the law no. 9947, dated 07.07.2008 “On Industrial Property”. This law is in line with Albania’s ongoing initiative to harmonize legislation with the “acquis communautaire” as well as with Directive 2016/943
on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure.
The law introduces novelties such as the:
- protection of trade secrets;
- establishment of a database system for industrial property rights (the Industrial Property Management System or IPMS); and
- regulatory instruments for the protection of industrial property rights by the State Inspectorate on Market Supervision (SIMS).
Particularly, in compliance with EU Directive 219/943, the law provides specific rules and provisions regarding:
- protection of trade secrets against illegal appropriation, misuse and detection in the domestic market,
- provision of a sufficient level of compensation in case of misuse,
- maintenance of the confidentiality of trade secrets during and after litigation,
- prevention of third-party misuse or dishonest use of trade secret.
Moreover, the new amendments have formalized the state database by creating the Industrial Property Management System – a unique register that collects and processes data on industrial property, including all requests deposited by local or foreign individuals/entities aiming to register industrial
property objects in the Republic of Albania. This system provides for more efficient information and interaction with both domestic and international organizations in the field of industrial property.
In conclusion, the final provisions of the law relate to the SIMS’ (State Inspectorate on Market Supervision) competence with regard to the protection of industrial property rights, as a result of a recommendation of the European Commission. SIMS is stipulated to be the competent authority for monitoring the observance of IP rights whether there are reasonable grounds for suspecting that an industrial property right has been infringed by goods that are placed on the market and are in service/use in the territory of the Republic of Albania, after release for free circulation by the customs authorities.
SIMS operates ex-officio or on the basis of a request-complaint for inspection of the holder of the right.

Ndryshime të reja në ligjin nr. 9947, datë 07.07.2008 “Për Pronësinë Industriale” Me propozim të Këshillit të Ministrave, Parlamenti miratoi Ligjin Nr. 96/2021 “Për ndryshimet dhe shtesat e ligjit nr. 9947, datë 07.07.2008 “Për Pronësinë Industriale”. Ky ligj është në përputhje me nismën e vazhdueshme të Shqipërisë për harmonizimin e legjislacionit me “acquis communautaire” si dhe me Direktivën 2016/943 mbi mbrojtjen e njohurive të panjohura dhe informacionit të biznesit (sekretet tregtare) kundër blerjes së paligjshme të tyre, përdorimit dhe zbulimit.
Ligji prezanton risi të tilla si:
- mbrojtja e sekreteve tregtare;
- krijimi i sistemit të bazës së të dhënave për të drejtat e pronësisë industriale (Sistemi i Menaxhimit të Pronësisë Industriale ose IPMS); dhe
- instrumentet rregullatore për mbrojtjen e të drejtave të pronësisë industriale nga Inspektorati Shtetëror për Mbikëqyrjen e Tregut (SIMS).
Veçanërisht, në përputhje me Direktivën e BE -së 219/943, ligji siguron rregulla dhe dispozita specifike në lidhje me:
- mbrojtja e sekreteve tregtare nga përvetësimi i paligjshëm, keqpërdorimi dhe zbulimi në tregun e brendshëm,
- sigurimi i një niveli të mjaftueshëm kompensimi në rast të keqpërdorimit,
- ruajtja e konfidencialitetit të sekreteve tregtare gjatë dhe pas procesit gjyqësor,
- parandalimi i keqpërdorimit të palëve të treta ose përdorimi i pandershëm i sekretit tregtar.
Për më tepër, ndryshimet e reja kanë zyrtarizuar bazën e të dhënave shtetërore duke krijuar Sistemin e Menaxhimit të Pronësisë Industriale – një regjistër unik që mbledh dhe përpunon të dhëna mbi pronësinë industriale, duke përfshirë të gjitha kërkesat e depozituara nga individë/subjekte vendas ose të huaj që synojnë të regjistrojnë industriale objekte pronësore në Republikën e Shqipërisë. Ky sistem siguron informacion dhe ndërveprim më efikas me organizatat vendase dhe ndërkombëtare në fushën e pronësisë industriale.
Si përfundim, dispozitat përfundimtare të ligjit lidhen me kompetencën e SIMS (Inspektorati Shtetëror për Mbikëqyrjen e Tregut) në lidhje me mbrojtjen e të drejtave të pronësisë industriale, si rezultat i një rekomandimi të Komisionit Evropian. SIMS përcaktohet të jetë autoriteti kompetent për monitorimin e respektimit të të drejtave të IP nëse ka arsye të arsyeshme për të dyshuar se një e drejtë e pronësisë industriale është shkelur nga mallrat që janë vendosur në treg dhe janë në shërbim / përdorim në territorin e Republikës të Shqipërisë, pas lëshimit në qarkullim të lirë nga autoritetet doganore.
SIMS funksionon sipas detyrës zyrtare ose në bazë të një kërkese-ankese për inspektimin e bartësit të së drejtës.
