Të ftuar për prezantimin dhe përgjigjen e pyetjeve të deputetëve mbi këtë projektligj ishin znj. Olta Manjani, zëvendësministre e Financave dhe Ekonomisë, si dhe stafi teknik i MFE. Gjatë prezantimit të saj znj.Manjani parashtroi se marrëveshja ndërmjet Shqipërisë dhe Konfederatës Zvicerane për mbrojtjen shoqërore është iniciuar në përputhje me eksperiencën ndërkombëtare në fushën e mbrojtjes shoqërore, ku mbrojtja e emigrantëve rregullohet nëpërmjet aderimit në instrumentet ligjore ndërkombëtare në fushën e mbrojtjes shoqërore, nënshkrimit të marrëveshjeve dypalëshe ndërmjet vendeve përkatëse, si dhe legjislacionit kombëtar. “Në lidhje me përfitimet e shtetasve shqiptarë këtu vlen të theksohet bashkimi i periudhave të sigurimit dhe përllogaritja e këtyre përfitimeve. Në këtë aspekt nëse një person nuk i plotëson kushtet për realizimin e të drejtës për përfitime vetëm në bazë të periudhave të sigurimit të realizuar sipas legjislacionit shqiptar atëherë me qëllim për të përmbushur periudhën minimale të sigurimit të nevojshme për tu pajisur me të drejtën për përfitime do të merren në konsideratë edhe periudhat e sigurimit të realizuara sipas legjislacionit zviceran, me kusht që këto periudha të mos mbivendosen me periudhat e sigurimit shqiptar dhe që periudha minimale e sigurimit shqiptar të jetë të paktën 1 vit”, sqaroi znj.Manjani, duke shtuar se zbatimi i marrëveshjes nuk ka efekte financiare të menjëhershme dhe se do të sjellë si avantazh të rëndësishëm për shtetasit respektivë, bashkimin e periudhave të sigurimit dhe përfitimin e pensionit në të dy vendet. Deputetja znj.Sorina Koti në cilësinë e relatores sqaroi se marrëveshja konsiston në ofrimin e përfitimeve në sigurimet shoqërore dhe bazohet në parimin e trajtimit të barabartë të punëtorëve në punësim, trajtimin me përfitime dhe të ardhura. “Objekt i kësaj marrëveshjeje janë përfitimet nga skema shqiptare e detyrueshme e sigurimeve shoqërore, të cilat përfshijnë konkretisht pensionin e pleqërisë, pensionin familjar dhe pensionin e invaliditetit, ndërsa në lidhje me Konfederatën Zvicerane janë përfitimet që rrjedhin nga ligji federal i 20 dhjetorit 1946 mbi sigurimin e pleqërisë dhe sigurimin familjar dhe përfitimet nga ligji federal i 19 qershorit 1959 mbi sigurimin e invaliditetit. Palët kanë rënë dakord t’i japin këto përfitime, bazuar në legjislacionet përkatëse të mbrojtjes shoqërore”, sqaroi znj.Koti. Pas pyetjeve dhe diskutime, komisioni miratoi në parim, nen për nen dhe në tërësi projektligjin në fjalë.
Invited for the presentation and the answer to the questions of the deputies on this draft law were Mrs. Olta Manjani, Deputy Minister of Finance and Economy, as well as the technical staff of MFE. During her presentation, Ms. Manjani stated that the agreement between Albania and the Swiss Confederation on social protection was initiated in accordance with the international experience in the field of social protection, where the protection of immigrants is regulated through the accession to international legal instruments in the field of social protection, the signing of bilateral agreements between the respective countries, as well as national legislation. “Regarding the benefits of Albanian citizens, it is worth noting here the joining of insurance periods and the calculation of these benefits. In this aspect, if a person does not meet the conditions for the realization of the right to benefits based only on the periods of insurance realized according to the Albanian legislation, then in order to fulfill the minimum period of insurance necessary to be equipped with the right to benefits to take into consideration the insurance periods realized according to Swiss legislation, provided that these periods do not overlap with the Albanian insurance periods and that the minimum period of Albanian insurance is at least 1 year”, clarified Ms. Manjani, adding that the implementation of the agreement does not have immediate financial effects and that it will bring as an important advantage for the respective citizens, the unification of insurance periods and the benefit of pension in both countries. Member of Parliament Mrs. Sorina Koti, in the capacity of rapporteur, explained that the agreement consists in the provision of social security benefits and is based on the principle of equal treatment of workers in employment, treatment with benefits and income. “The object of this agreement are the benefits from the mandatory Albanian social insurance scheme, which specifically include the old-age pension, the family pension and the disability pension, while in relation to the Swiss Confederation are the benefits derived from the federal law of December 20, 1946 on insurance old-age and family insurance and benefits from the federal law of June 19, 1959 on disability insurance. The parties have agreed to provide these benefits, based on the relevant social protection legislation”, explained Mrs. Koti. After questions and discussions, the committee approved in principle, article by article and in its entirety the draft law in question.
